These Terms & Conditions apply to the services offered and organised by Costaexcursions S.L. (“Costaexcursions”, “we”, “us” or “our”), a travel company based in Andalusia, Spain.

Costaexcursions specialises in the organisation and sale of private tours, excursions, sightseeing experiences, shore excursions, guided visits and other tourism-related activities in Málaga, Costa del Sol and other destinations in Andalusia.

 

1. Nature of our services

Costaexcursions acts as a travel company and tour operator, organising and/or commercialising tourism experiences that may combine different services, including, depending on the product:

• sightseeing and cultural visits;
• private guided tours;
• visits to wineries and other tourism establishments;
• food and wine experiences;
• outdoor and active tourism activities;
• entrance tickets and reservations;
• professional guiding services;
• transportation associated with and complementary to the tourism experience.

The exact services included in each booking are those expressly described in the corresponding tour or quotation.

 

2. Transportation associated with our tours

Where transportation is included in a Costaexcursions tour or experience, it is provided as an ancillary and complementary element of the overall tourism service and is not offered or sold as an independent point-to-point transportation service.

The purpose of the transportation is to enable and facilitate the provision of the tourism experience booked by the customer, including access to the destinations, activities, guided visits and other services forming part of the booked experience.

Accordingly, customers do not contract with Costaexcursions for a standalone transfer or private-hire transportation service unless this is expressly stated otherwise in writing.

Where appropriate and depending on the nature, size or requirements of a booking, Costaexcursions may arrange transportation through appropriately authorised third-party transportation providers.

 

3. Private tours and customised itineraries

Many Costaexcursions experiences are private and may be customised according to the customer’s interests, available time and the operational feasibility of the requested itinerary.

Customisation does not change the nature of the service: where transportation is included, it remains ancillary to the tourism experience and is not offered as an independent transportation service.

Requests involving destinations, activities, timings or combinations of services that are not operationally feasible may be declined or modified.

 

4. Vehicles

Where Costaexcursions provides transportation associated with a tourism experience using vehicles available to the company, such transportation is provided exclusively in connection with the tourism services booked by the customer.

The vehicle used will depend on the number of participants, itinerary and characteristics of the booked experience.

Transportation may also be provided by an appropriately authorised third-party transportation company where required by the applicable regulations or by the characteristics of the service.

 

5. Third-party services

Some components of a Costaexcursions experience may be provided by independent third-party suppliers, including licensed tourist guides, wineries, attractions, activity providers, transportation companies, restaurants and other tourism establishments.

Where a service is provided by a third party, that provider may be responsible for the direct provision of that particular service in accordance with the applicable legislation and its own terms and conditions.

Costaexcursions will clearly indicate, where relevant, when a service is provided by an external supplier.

 

6. Booking and confirmation

A booking becomes confirmed once Costaexcursions has accepted the reservation and the applicable payment or deposit has been received.

The customer will receive confirmation specifying the principal services included in the booking.

Unless expressly stated in the booking confirmation, entrance fees, tickets, meals, drinks, guided visits, activities or other services are not included in the price.

 

7. Prices

The price of each experience is the price stated in the quotation or booking confirmation.

Any additional services requested after confirmation may be subject to an additional charge.

Where a quotation specifies that certain services or entrance fees are not included, these services are payable separately by the customer unless otherwise agreed in writing.

 

8. Customer responsibility

Customers are responsible for providing accurate information concerning:

• number of participants;
• ages of participants where relevant;
• accommodation or meeting point;
• mobility or accessibility requirements;
• relevant dietary requirements;
• any other information reasonably required to provide the booked experience.

Customers must follow the reasonable instructions of Costaexcursions staff, guides, drivers and activity providers during the tour.

 

9. Active tourism and outdoor activities

Certain Costaexcursions experiences may constitute active tourism or outdoor activities.

Participants must comply with the instructions and safety requirements established by the responsible guide, instructor, activity provider or other qualified professional.

Participants acknowledge that outdoor and active tourism activities may involve inherent risks associated with terrain, weather, physical activity and other circumstances.

Costaexcursions maintains the insurance and authorisations required for the tourism activities that it directly provides, where applicable.

 

10. Delays and itinerary changes

The itinerary and estimated timings provided to customers are subject to traffic, weather conditions, operational restrictions, opening hours, unforeseen circumstances and other factors outside Costaexcursions’ reasonable control.

Costaexcursions may modify the order or timing of activities when reasonably necessary to ensure the proper provision of the experience.

Where a significant change is required, Costaexcursions will make reasonable efforts to inform the customer and provide an appropriate alternative.

 

11. Cancellation

Cancellation conditions applicable to each booking will be stated in the quotation, booking confirmation or specific cancellation policy supplied to the customer.

Where no specific cancellation conditions have been agreed, Costaexcursions’ standard cancellation policy will apply.

 

12. Liability

Costaexcursions is responsible for the proper organisation and provision of the services that it directly provides and for fulfilling the obligations applicable to its role as a travel company.

Where a component of the experience is provided directly by an independent third-party supplier, the responsibility for the direct provision of that component will remain with the relevant supplier, without prejudice to any responsibilities that may arise for Costaexcursions under applicable consumer and travel legislation.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under Spanish or European consumer legislation.

 

13. Applicable legislation

Costaexcursions operates in accordance with the applicable Spanish and Andalusian legislation governing tourism, travel services, consumer protection, active tourism and, where applicable, transportation.

In particular, the services of Costaexcursions may be subject to the applicable provisions of:

• Law 13/2011, of 23 December, on Tourism in Andalusia;
• Decree 114/2023, of 23 May, regulating travel intermediary companies organising or commercialising package travel and companies facilitating linked travel services in Andalusia;
• Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, including its provisions concerning package travel and linked travel arrangements;
• Law 16/1987, of 30 July, on the Organisation of Land Transport (LOTT) and its implementing regulations, where applicable;
• the applicable Andalusian regulations governing active tourism and other tourism activities.

 

14. Transportation regulations

Where transportation forms part of a tourism experience, Costaexcursions will comply with the transportation legislation applicable to the specific service and vehicle concerned.

Nothing in these Terms & Conditions should be interpreted as offering an independent passenger transportation, taxi, VTC or private-hire transportation service where Costaexcursions is not legally authorised to provide such service.

Where the applicable legislation requires transportation to be provided by an authorised transportation operator, Costaexcursions may subcontract the relevant service to such operator.

 

15. Complaints

Customers may contact Costaexcursions regarding any complaint or issue concerning a booked service.

Complaints should be submitted as soon as reasonably possible so that Costaexcursions and, where relevant, the corresponding service provider can investigate and seek an appropriate solution.

 

16. Privacy

Personal data will be processed in accordance with Costaexcursions’ Privacy Policy and applicable data protection legislation.

 

17. Governing law

These Terms & Conditions are governed by Spanish law.

Mandatory consumer protection rights applicable to the customer under Spanish or European legislation remain unaffected by these Terms & Conditions.
